Mallsai - Packed Clay

Hello! I just received the Greater Duke Jasmine I ordered over the internet. As expected, there is a this layer of gravel over dense, packed soil, possibly clay. The water just went over the edges of the pot, probably barely water the poor tree Anyway, my question is this: Should I replant said tree into a better soil mixture ASAP, or wait until spring?

Not familiar with that particular species - if you're uncertain about the best time to repot then try dunking the whole pot into water for 20 minutes to see what is absorbed, or carefully poke a few holes into the packed soil to let water in.
Personally I'd be inclined to take it out , carefully wash off all of the old soil and replant with decent free draining stuff, but that's just my opinion, not necessarily the right thing to do!
